Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Oack website (oack.io), platform (app.oack.io), APIs, and related services (collectively, the "Service") provided by Oack ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Account Terms

  • You must be at least 16 years old to use the Service.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials. We recommend using OAuth sign-in (Google, GitHub, Slack) and strong, unique passwords if using email/password authentication.
  • You are responsible for all activity that occurs under your account.
  • One person or organization may maintain multiple accounts, but each account must correspond to a distinct business entity or use case.
  • You must notify us immediately at [email protected] or via Discord / Telegram if you suspect unauthorized access to your account.

2. The Service

Oack is a web monitoring and incident response platform. The Service includes:

  • HTTP/HTTPS monitoring — automated health checks of your web endpoints with configurable intervals, assertions, and alerting.
  • Alert notifications — delivery of alerts via email, Slack, Discord, Telegram, PagerDuty, webhooks, and other channels.
  • Status pages — public-facing status pages for communicating service health to your users.
  • Analytics and telemetry — performance metrics, uptime calculations, TCP-level diagnostics, and probe history.
  • API and CLI — programmatic access via REST API and the oackctl command-line tool.
  • MCP integration — read-only Model Context Protocol server for AI-assisted troubleshooting.

We reserve the right to modify, improve, or discontinue any feature of the Service at any time. We will make reasonable efforts to notify you of material changes.

3. Acceptable Use

You agree not to use the Service to:

  • Monitor endpoints you do not own or have explicit authorization to monitor.
  • Perform load testing, DDoS attacks, or any form of abuse against third-party infrastructure via our checkers.
  • Circumvent rate limits, plan restrictions, or technical safeguards of the Service.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Resell, redistribute, or sublicense the Service without our written consent.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate your account if we reasonably believe you are violating these terms. Where possible, we will notify you before taking action and give you an opportunity to resolve the issue.

4. Your Data

  • Ownership — you retain all rights to the data you submit to the Service. Your monitoring URLs, configurations, probe results, and any content you create (comments, incidents, status page content) belong to you.
  • License to us — you grant us a limited license to store, process, and display your data as necessary to provide the Service.
  • Export — you may export your data at any time through the API or CLI.
  • Deletion — when you delete your account, we will delete your data within 30 days, as described in our Privacy Policy.
  • Sensitive data — you are responsible for ensuring that custom headers, request bodies, or monitored URLs you configure do not inadvertently expose secrets (API keys, tokens, passwords) beyond what is necessary for monitoring.

5. Payment & Billing

  • Plans — the Service is available in Free, Pro, and Business tiers. Plan features and limits are described on the Pricing page and may change over time.
  • Billing cycle — paid plans are billed monthly in advance. All fees are quoted in USD and are non-refundable except as required by law.
  • Payment method — you must provide a valid payment method. We use a third-party payment processor and do not store credit card details on our servers.
  • Failed payments — if a payment fails, we will notify you and provide a grace period to update your payment method. If the issue is not resolved, your account will be downgraded to read-only mode (monitors continue running, but editing is restricted).
  • Plan changes — you may upgrade or downgrade at any time. When downgrading, monitors exceeding the new limit will be paused. You can unpause them after reducing your count.
  • Price changes — we may change pricing with 30 days' notice. Existing subscriptions will not be affected until the next renewal.

6. Free Tier

The Free tier is provided at no cost with limited features as described on the Pricing page. We reserve the right to:

  • Modify Free tier limits at any time with reasonable notice.
  • Suspend inactive Free accounts (no login for 12+ months) after prior notification.
  • Prioritize paid accounts for checker resources during periods of high demand.

7. Intellectual Property

The Service, including its design, code, algorithms, documentation, branding, and all related intellectual property, is owned by Oack and protected by applicable intellectual property laws.

These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

The oackctl CLI and network-tester checker are distributed as compiled binaries. Their use is governed by these Terms.

8. Uptime & Support

We make commercially reasonable efforts to maintain high availability of the Service. However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, infrastructure issues, or circumstances beyond our control.

Support is available via email ([email protected]), Discord, and Telegram. Response times depend on the nature of the issue and your plan.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Oack's total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, business interruption, or downtime of your services — regardless of the cause.
  • Oack is a monitoring tool, not a guarantee. We help you detect issues — we cannot prevent them. You remain responsible for the availability and security of your own infrastructure.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or completely secure.
  • Monitoring results will be 100% accurate at all times (network conditions, DNS caching, CDN behavior, and other factors can affect probe results).
  • Alert notifications will be delivered instantaneously (delivery depends on third-party services like email providers, Slack, Telegram, etc.).

11. Indemnification

You agree to indemnify and hold Oack harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service in violation of these Terms.
  • Monitoring endpoints you do not have authorization to monitor.
  • Any content you publish through status pages or shared links.

12. Termination

By you

You may cancel your account at any time from Account Settings. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period.
  • After the billing period ends, your data will be soft-deleted and permanently removed after 30 days.
  • You may export your data via the API or CLI before deletion.

By us

We may suspend or terminate your account if:

  • You violate these Terms or the Acceptable Use policy.
  • Your account has been inactive for more than 12 months (Free tier only, with prior notice).
  • Required by law or to protect the security of the Service.

Where possible, we will provide at least 14 days' notice before terminating an account, unless immediate action is required for security reasons.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Post the updated Terms on this page with a new effective date.
  • Notify you by email at least 14 days before the changes take effect.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation first. If negotiation fails, disputes will be resolved through binding arbitration or in the courts of competent jurisdiction.

15. General Provisions

  • Entire agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and Oack regarding the Service.
  • Severability — if any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
  • No waiver — our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
  • Assignment — you may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
  • Force majeure — neither party is liable for failure to perform due to circumstances beyond reasonable control (natural disasters, war, pandemics, internet outages, etc.).
